
Assumption of Risk Release of Liability Medical Authorization Media Consent
This agreement applies to the athlete identified below and to every Feather River Grappling tournament or related event activity in which the athlete participates, unless Cultivate Power Fighting Arts LLC provides a replacement agreement. An adult athlete signs for themself. If the athlete is under 18, a parent or legal guardian must sign both on behalf of the minor and in the parent or guardian's individual capacity.
Agreement
1 Covered Activities
I request and voluntarily agree that the athlete may enter, attend, observe, warm up for, train for, weigh in for, compete in, and otherwise participate in Feather River Grappling tournaments and related activities (collectively, the "Activities"). The Activities include Brazilian jiu-jitsu, submission grappling, gi and no-gi competition, drilling, sparring, takedowns, throws, pins, sweeps, positional control, chokes, strangles, joint locks, escapes, use of mats and equipment, awards activities, and presence in competition, warm-up, staging, spectator, and common areas.
2 Released Parties
The "Released Parties" are Cultivate Power Fighting Arts LLC, doing business as Feather River Grappling; its past, present, and future owners, members, managers, officers, employees, coaches, instructors, agents, contractors, referees, officials, medical personnel, volunteers, representatives, affiliates, successors, and assigns; each tournament promoter, sanctioning organization, sponsor, vendor, equipment provider, participating academy, school, club, team, and facility; each owner, landlord, lessor, lessee, operator, or manager of any venue or property where an Activity occurs; any governmental entity associated with the premises or event; and all other participants and their coaches, cornermen, and representatives.
3 Acknowledgment of Risks
I understand that grappling and combat-sport competition involve strenuous physical exertion, close physical contact, unpredictable movement, and intentional techniques designed to control or submit an opponent. Risks include, without limitation:
falls, trips, slips, collisions, impacts with persons, mats, barriers, walls, floors, or equipment, and errors in judgment or officiating;
bruises, cuts, abrasions, bleeding, sprains, strains, dislocations, fractures, dental or eye injuries, concussions, traumatic brain injury, choking, loss of consciousness, nerve damage, and joint, muscle, tendon, ligament, neck, back, or spinal injury;
catastrophic injury, paralysis, permanent disability, cardiac events, illness, communicable disease or infection, and death;
risks arising from differences in an opponent's size, weight, age, rank, skill, strength, condition, conduct, or competitive intensity;
inadequate or defective premises, mats, barriers, safety equipment, or other equipment; delayed or unavailable medical care; and negligent acts or omissions of one or more Released Parties or other persons; and
known and unknown risks, foreseeable and unforeseeable risks, and risks that cannot be eliminated without changing the essential nature of the Activities.
I understand that rules, referees, safety procedures, weight classes, medical screening, and protective equipment may reduce but cannot eliminate these risks. The athlete may stop participating or decline a match before it begins, but competition and training conditions can change rapidly.
4 Health and Fitness Representations
I represent that the athlete is physically and mentally able to participate safely and has no condition, injury, illness, medication restriction, or other limitation that makes participation unsafe or that has not been appropriately evaluated. I accept responsibility for deciding whether the athlete should participate and for obtaining medical advice when appropriate. I will promptly report any injury or condition that could affect safe participation. I understand that the Released Parties are not providing a medical examination or guaranteeing the athlete's fitness.
5 Assumption of Risk
I KNOWINGLY AND VOLUNTARILY ACCEPT AND ASSUME ALL RISKS OF THE ACTIVITIES, INCLUDING THE RISKS DESCRIBED ABOVE AND RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY, TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW. I accept full responsibility for injury, illness, disability, death, property damage, or other loss suffered by the athlete or me in connection with the Activities.
6 Release and Waiver of Liability
IN CONSIDERATION FOR BEING ALLOWED TO PARTICIPATE, I, FOR MYSELF AND FOR THE ATHLETE WHEN I AM THE ATHLETE'S PARENT OR LEGAL GUARDIAN, RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, ACTIONS, AND CAUSES OF ACTION ARISING FROM OR RELATED TO THE ACTIVITIES, INCLUDING CLAIMS FOR PERSONAL INJURY, ILLNESS, DISABILITY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. THIS RELEASE IS INTENDED TO BE AS BROAD AS CALIFORNIA LAW PERMITS.
This agreement does not release claims that California law does not permit to be released, including claims based on gross negligence, reckless misconduct, willful or intentional misconduct, or fraud.
7 Covenant Not to Sue and Indemnity
To the fullest extent permitted by law, I agree not to sue or bring a claim against a Released Party for any matter released by this agreement. I further agree to indemnify, defend, and hold harmless the Released Parties from claims, liabilities, damages, judgments, and reasonable defense costs arising from: (a) the athlete's participation in the Activities; (b) injury or damage caused by the athlete or by my conduct; (c) my breach of this agreement; or (d) a claim brought by or on behalf of the minor athlete concerning a matter covered by this agreement, except to the extent the claim arises from conduct that cannot lawfully be released or indemnified. This paragraph does not require indemnification for a Released Party's gross negligence, reckless misconduct, willful or intentional misconduct, or fraud.
8 Emergency Care and Medical Authorization
If the athlete appears to need medical attention and I or another authorized decision-maker cannot be reached promptly, I authorize the Released Parties to obtain or arrange reasonable first aid, emergency evaluation, emergency transportation, and medical, dental, or hospital treatment for the athlete. I understand that the Released Parties are not required to provide medical personnel or treatment and do not guarantee the availability or quality of care. I accept responsibility for all resulting charges and authorize disclosure of information reasonably necessary to provide or coordinate emergency care. This authorization does not replace any separate medical consent required by a healthcare provider.
9 Rules and Removal
The athlete will follow event rules, referee instructions, venue requirements, and safety directions. Feather River Grappling may refuse, suspend, or end participation when it reasonably believes participation is unsafe, disruptive, dishonest, or contrary to event rules. Removal does not create a right to a refund except as provided by the event's published refund policy.
10 Personal Property
I accept responsibility for the athlete's personal property. The Released Parties are not responsible for lost, stolen, misplaced, or damaged property except to the extent liability cannot lawfully be waived.
11 Required Media Consent
I authorize Cultivate Power Fighting Arts LLC, doing business as Feather River Grappling, and its designees to photograph, film, livestream, record, edit, reproduce, publish, display, distribute, and otherwise use the athlete's name, image, likeness, voice, statements, and competition results captured in connection with the Activities. This authorization is worldwide, perpetual, royalty-free, transferable, and may be used in any lawful medium for event coverage, results, promotion, advertising, social media, websites, broadcasts, archival use, and commercial or nonprofit communications. I waive inspection or approval rights and any claim to compensation. I understand that recordings may be publicly available and may be copied or shared by others. This consent does not authorize a misleading endorsement unrelated to Feather River Grappling or the Activities.
12 California Law and Venue
California law governs this agreement, without regard to conflict-of-law principles. Any lawsuit arising from or relating to this agreement or the Activities must be filed exclusively in a state court located in Butte County, California, or, if federal jurisdiction exists, in the federal court serving Butte County. Each signer consents to personal jurisdiction and venue in those courts, to the fullest extent permitted by law.
13 Continuing Agreement and Severability
This is a continuing agreement covering the athlete's participation in all Feather River Grappling tournaments and related Activities at any location. It remains effective until Cultivate Power Fighting Arts LLC replaces it in writing; however, a replacement does not affect claims arising before replacement. If any provision is held invalid or unenforceable, it will be modified only to the minimum extent necessary or severed, and the remaining provisions will remain effective. This agreement is the entire agreement concerning the subjects it addresses and may be modified only in a writing issued or signed by Cultivate Power Fighting Arts LLC. Headings are for convenience and do not limit the agreement.
14 Electronic Signature and Acknowledgments
I agree to conduct this transaction electronically. I intend my typed name, checkbox acknowledgment, and electronic signature to constitute my legal signature. I understand that Feather River Grappling may retain this agreement with associated electronic records, including date and time, email address, IP address, and registration information, and may provide an electronic copy to me.
BY SIGNING, I CONFIRM THAT I HAVE READ THIS ENTIRE AGREEMENT, UNDERSTAND IT, HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS AND SEEK LEGAL ADVICE, AND SIGN VOLUNTARILY. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR CLAIMS BASED ON ORDINARY NEGLIGENCE.
